Organizational Setting

The Office of Legal Affairs (OLA), which reports directly to the Director General, provides legal services of the highest standard to the Director General, the Secretariat, and the policy making organs of the IAEA, as well as to Member States, in connection with the implementation of the IAEA’s activities.

The Nuclear and Treaty Law Section of OLA provides legal advice and support in the areas of nuclear safety, nuclear security, civil liability for nuclear damage, nuclear energy, nuclear applications, and technical cooperation. The Section is responsible for implementing the IAEA Legislative Assistance Programme and for carrying out the IAEA’s depositary functions. It provides advice and training to Member States on legal instruments adopted by or under the auspices of the IAEA and on national legislation for the safe, secure, and peaceful uses of nuclear technology.
 

Main Purpose

Under the guidance of the Head of the Nuclear and Treaty Law Section, the consultant contributes specialized legal expertise in international and national nuclear law and related legal frameworks including, legislative, regulatory and contractual aspects relevant to the safe, secure, and peaceful uses of nuclear technology.

The consultant may participate in IAEA missions and other activities addressing these frameworks. The consultant may review draft and enacted legislation and contribute to awareness-raising missions, workshops and training courses, including through the delivery of lectures, case studies, and practical exercises designed to transfer legal knowledge and skills.

Qualified consultants who are available for short-term and/or temporary assignments are invited to register and create their Candidate Profile.

Knowledge, Skills and Abilities

Candidates must have expertise in at least one of the following areas:

-International legal instruments adopted by and under IAEA auspices on nuclear safety, nuclear security, and civil liability for nuclear damage.

-Legal frameworks for the safe, secure and peaceful uses of nuclear technology and its applications.

-Drafting legislation in all areas of nuclear law and reviewing draft and enacted nuclear legislation covering one or more of the following:

national systems of regulatory control of nuclear facilities and activities,

radiation protection,

radiation safety,

decommissioning of facilities,

emergency preparedness and response,

mining and processing of radioactive material,

transport of radioactive material,

radioactive waste and spent fuel management,

nuclear liability,

nuclear security including physical protection of nuclear material and facilities and/or the security or radioactive sources.

-Advising on legislation and related aspects concerning nuclear power programmes and projects, including one or more of the following subjects:

Environmental protection,

EPR,

Occupational health and safety of workers,

Protection of intellectual property,

Local land use controls,

Foreign investment,

Taxation, fees, electricity tariffs and incentives,

Roles of national and local governments,

Stakeholders and public involvement,

International trade and customs,

Financial guarantees and any other required financial legislation including R&D.

-Advising on commercial and contractual arrangements for nuclear projects.

-Knowledge of key IAEA publications, safety standards, nuclear security guidance and other guidance documents including the IAEA Milestones Approach.

Education, Experience and Language Skills

Member of a national bar or equivalent. Proven ability to prepare legal drafts and advise a broad range of stakeholders from governmental bodies. Minimum of ten years relevant experience, including several years at the international level and/or advising governmental officials on nuclear related matters.

Excellent command of written and spoken English is essential. Knowledge of another other UN official language (i.e. Arabic, Chinese, French, Spanish and/or Russian) is an asset.

Remuneration

The remuneration for consultant assignments depends on the assignment and the consultant’s qualifications and ranges between €300 and €480 per day. In case duty travel is required within the assignment, a daily subsistence allowance (DSA) and travel costs are provided. Health coverage and pension fund are the responsibility of the incumbent.

Further details on the duration, duty station, organizational context and qualification requirements may and will be provided to one or more preselected consultants for a specific assignment at the discretion of IAEA responsible staff.

The Pipeline will be used to create a roster of consultants. The validity of the roster application will be for two years upon the submission of the application. Registration in the Pipeline does not constitute any formal obligation on the side of the IAEA to offer any type of employment.
